Whitestown Man Arrested on Felony DWI Charges After Being Found Unconscious Behind the Wheel in New Hartford

Felony DWI Charge
On Tuesday, July 7th, at approximately 9:00 p.m., New Hartford Police responded to the area of 151 Clinton Road for a report of a vehicle that, according to the reporting person, may have been possibly involved in a collision.
It was reported that the vehicle was stopped in the parking lot and occupied by an unresponsive male driver at this time within the parking lot at 151 Clinton Rd.
Upon arrival, officers located a running 2011 Ford Escape with an adult male passed out and seated in the driver's seat while the car was held at a stop by the operator's foot resting on the brake pedal. Officers were able to wake the operator. Upon making contact with the operator, the operator was identified as Vincent Infusino, age 43, of Whitestown. During the investigation, officers observed signs of intoxication.
Police administered standard field sobriety tests upon Infusino. Based on the results of the investigation, Infusino was arrested and charged with Driving While Intoxicated. Further investigation by police determined that Infusino would be charged with Felony Driving While Intoxicated. Infusino was arrested and transported to the New Hartford Police Department, where a breath test was administered. Infusino was charged with the following:
1) NYS VTL 1192(3) -Driving While Intoxicated, a Misdemeanor.
2) NYS VTL 1192(2) – Driving While Intoxicated, Previous DWI Convictions within 10 Years, a Felony.
After Infusino was processed on the charges, he was transported to the Oneida County Jail to be held for arraignment. The circumstances surrounding the reported collision remain under investigation.
